Agreeing to these terms

These terms are an agreement between you and the people who make Nocta ("Nocta", "we", "us"). By using Nocta, you agree to them. If you don't agree, please don't use Nocta. Our Privacy Policy explains what we keep about you.

Nocta is not medical advice

Nocta is a wellness companion. It shows the data your CPAP machine and wearables record and describes patterns in plain language. It is not a medical device, and it does not diagnose, treat, cure or prevent any condition.

• Don't use Nocta to change your CPAP pressure, adjust your equipment settings, or stop or change your therapy. Those decisions belong to you and your doctor.
• When Nocta suggests talking to your doctor, please do.
• Nocta can be wrong. Data from an SD card or a wearable can be missing or inaccurate, and Nocta's explanations can miss things.
• In an emergency, call 911 or your local emergency number. Nocta does not monitor you and can't alert anyone.

Who can use Nocta

You must be at least 18 to use Nocta. If you create an account, give accurate information and keep your sign-in safe. You're responsible for what happens under your account. Tell us right away if you think someone else is using it.

Your data

Your data is yours. You give us permission to store and process it only as needed to run Nocta for you, as described in the Privacy Policy. You can export it or delete your account at any time from Settings.

Only add data that's yours, or that you have permission to use.

Other companies' services

Nocta works with data from ResMed CPAP machines and lets you connect accounts with Oura, Google (for Fitbit) and Whoop. Those companies' own terms and privacy policies apply to your accounts with them. Nocta is not made by, affiliated with or endorsed by any of them, and their names and trademarks belong to them. We aren't responsible for their services, and a company may change or stop what it offers, which can change what Nocta can show you.

Using Nocta fairly

When you use Nocta, please don't:

• Break the law, or use Nocta to harm anyone.
• Try to get into accounts, data or systems that aren't yours.
• Interfere with Nocta, overload it, or get around its security.
• Copy, resell or rebrand Nocta, or use it to build a competing service.

Changes to Nocta

Nocta is still being built. Features may change, pause or end, and the app may sometimes be unavailable. We'll try to give notice of big changes, but we can't promise to.

No warranty

Nocta is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that Nocta will be accurate, complete, reliable, uninterrupted or error-free, or that it will meet your needs.

Limits on our responsibility

To the fullest extent the law allows, Nocta and the people who make it are not liable for any indirect, incidental, special or consequential damages, or for any decision you make based on what Nocta shows. That includes decisions about your health or therapy. Some places don't allow these limits, so they may not all apply to you.

Ending things

You can stop using Nocta and delete your account at any time from Settings. We may suspend or close an account that breaks these terms or puts Nocta or other people at risk.

Changes to these terms

If we change these terms, we'll update the date at the top. If a change is significant, we'll tell you in the app first. Using Nocta after a change means you accept the new terms.
